Marriage Visa vs. Fiance’(e) Visa

    1. A fiancée visa processes faster, in 4-6 months on average.
    2. A marriage visa processes slower, in 10-12 months on average.
    3. With a marriage visa the green card is processed at the same time as the visa. The applicants  are issued  1 year green cards upon arrival in the U.S. and a 2 green card is issued automatically. Upon arrival in the U.S. there is nothing further required of you or your wife.
    4. With a fiancé visa a green card application (adjustment of status to legal permanent resident) must be filed within 90 days of the fiancés arrival in the U.S. and after marriage to the U.S. citizen petitioner. The applicant must attend a bio-metrics appointment to be photographed and fingerprinted and both the fiancé and U.S. citizen will be interviewed by an immigration officer, in most cases. The same applies for any and all children accompanying your fiance. Your fiance may work upon receiving employment authorization or a green card.     5. With a marriage visa your spouse can begin to work immediately upon arrival in the U.S.
    6. With a fiancé visa children of the applicant up to 21 years of age can receive visas and accompany the applicant.
    7. With a marriage visa, children of any age can immigrate to the U.S. but the marriage between the U.S. citizen petitioner and his/her spouse and  must have taken place prior to the 18th birthday of the spouse’s children in order for the children to receive visas. Each child must submit and process a separate visa application.
    8. Government Fees for a fiancee visa: one application fee for the fiance and any and all children = $535.00, medical exam for each applicant = $275.00, Embassy fee for each applicant = $275.00   Total = $1,085.00 Green card application (adjustment of status to legal permanent resident = $1,225.00 per person.     9. Government fees for a marriage visa: application fee for each applicant = $535.00, medical exam for each applicant = $275.00, NVC fees for each applicant  = $445.00, USCIS fee for each applicant = $165.00. Total = $1,420.00
